Privacy policy

We take the protection of your personal data very seriously and abide by the rules of data protection laws.
The data collected on this website are technically necessary for the functioning of the website. Each time information is accessed, we – and in some cases third parties – therefore store non-personally identifiable access data about this process in the form of log files (e.g., browser type/version, operating system used, referrer URL (the previously visited page), host name of the accessing computer (shortened IP address) and time of the server request). These data are stored anonymously and cannot be assigned to specific persons. The processing of data is based on our legitimate interest (Art. 6(1)(f) GDPR) in the correct and optimised display of the website.
As a matter of principle, we only process personal data insofar as this is necessary for providing a functional website and the content and services we offer. Among other things, we thus only collect personal data if you voluntarily provide them to us when registering for the newsletter, registering for one of our events/webinars or using the contact form. We use the data that you provided to us exclusively to send information for the indicated purpose – i.e., newsletters or information about the event in question. Under no circumstances will we pass on the data collected to third parties without your express consent. For more information, please also see the sections “EVACO newsletter” and “Contact forms / Contact Form 7 / Flamingo plugin”.
Please note that according to Art. 21(1) GDPR, you have the right to object to any data processing that is based on a legitimate interest on our part or that of a third party (Art. 6(1)(f) GDPR). You can find more information about your basic rights under “Rights of data subjects” at the very bottom of this Privacy Policy.

Use of cookies

We use cookies, which are stored on your computer for the duration of your visit to the website, to improve the user experience and the security of the website. Cookies are small text files that are placed on your computer and stored in your browser. For information about cookies from web analytics services, please see the “Google Analytics” section. You can configure your browser so that no cookies are stored on your hard drive and that any cookies that have already been stored are deleted. However, in order to benefit from all the functions of the website, we recommend that you allow the use of cookies.
Customise your cookie settings:

Use of Google Analytics

This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses so-called “cookies”, which are text files placed on your computer that allow your use of the website to be analysed. The corresponding Google Analytics cookies are included as voluntary cookies with the statistics cookies, which means that you can also refuse the use of this service (see below for more details). The information generated by these cookies could also be transmitted to a server in a third country. According to Google, the following personal data may be processed: online identifiers (including cookie identifiers), IP address and device identifiers, and customer-assigned identifiers. The IP address provided by your browser in the framework of Google Analytics will not be combined with other data from Google. We have also added the “anonymizeIP” code to the Google Analytics code used on this website. In the European Union or in other contracting states of the Agreement on the European Economic Area, the IP address will thus be truncated. Only in exceptional cases will IP addresses be transferred to a Google server in the USA and truncated there.
The following cookies are used by Google Analytics:

  • _ga (duration: 2 years): stores a randomly generated user ID that can be used to identify returning users and merge the data with data from previous visits
  • _gid (duration: 24 hours): stores a randomly generated user ID that can be used to identify returning users and merge the data with data from previous visits
  • _gat (duration: 1 minute): used to throttle the request rate
  • _ga_ (duration: 2 years): used to maintain the session status

We have concluded an order processing agreement with Google for the use of Google Analytics in accordance with Art. 28 GDPR. Any such transfer to a third country will be based on the standard contractual clauses. Google will use the information on our behalf for the purposes of evaluating your use of the website and compiling reports on website activity. As such, we use this service for the purpose of analysing user behaviour on the website.

Data processing by Google Analytics will only take place if you have given your consent within the meaning of Art. 6(1)(a) GDPR. However, we would like to point out that if you have not given your consent, you may not be able to use all the functions of this website to their full extent. You can give your consent via the cookie box that is displayed when you first visit the website. You can adjust and revoke these settings at any time in this Privacy Policy under “Use of cookies”. You can also prevent the collection of the data generated by this cookie and relating to your use of the website (including your IP address) by Google, as well as the processing of these data by Google, by downloading and installing a browser plugin available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

We will continue to use Google Analytics to analyse data from double-click cookies and Google Ads for statistical purposes. If you do not want your data to be used in this manner, you can deactivate this function via the Ads Preferences Manager (https://adssettings.google.com/notarget?hl=de).

Use of Google Ads

This website uses Google Ads, a service provided by Google Ireland Limited (“Google”), Gordon House, Barrow St, Dublin, Ireland. We use website conversion tracking in Google Ads. When you interact with an advertisement placed by us, Google Ads will store a cookie in your browser with information about the interaction and a unique user identifier. Your IP address will also be processed. These cookies lose their validity after 30 days (= conversion tracking period). If a predefined event is triggered within this period, e.g., by visiting a subpage on our website, we and Google will be able to recognise that an interaction with one of our advertisements took place prior to this event. This enables us to determine which types of advertising are most useful to us and how we can present advertisements to you in a way that is tailored to your interests.
The information generated by these cookies may also be transmitted to a server in a third country. Among other places, Google may also process the data in the USA. Any such data processing in a third country will be based on the standard contractual clauses.

The following cookies may be used by Google Ads:

  • test_cookie (duration: 15 minutes): used in part to test the functionality of placing the cookie
  • IDE (duration: 13 months): used to recognise returning visitors and to present them with personalised advertisements
  • _gcl_au (duration: 90 days): contains a randomly generated user ID for storing and tracking conversions

Data processing by Google Ads will only take place if you have given your consent within the meaning of Art.

To disable this function, you also have the option of downloading certain browser plugins. These will stop the browser from accepting the corresponding cookies, which will then also not be stored. If you have a Google account, you also have the option of deactivating personalised advertising in the Google settings.

Registration via this website (newsletter, forms, etc.)

EVACOletter

If you would like to receive the newsletter offered at www.evaco.de, which is divided into the EVACOletter and the Webinar Reminder, we require an email address from you, as well as information that allows us to verify that you are the owner of the email address provided and that you agree to receive the newsletter. We use these data exclusively for sending the requested information and offers.

We use the so-called double opt-in procedure to ensure that the newsletter is sent with your consent. In the course of this procedure, potential recipients agree to be added to a distribution list. Subsequently, users are given the opportunity to confirm their registration in a legally compliant manner by means of a confirmation email. The address will only be included in the distribution list if such confirmation is received.

The newsletter software we use is Sendinblue. As part of this registration, you agree that the data you have provided will be transmitted to Sendinblue. Please refer to the Privacy Policy and General Terms and Conditions of Sendinblue. Sendinblue is absolutely prohibited from passing on your data to third parties and ensures that our use of these data is fully secure. In order to guarantee this, we have also concluded an order processing contract with Sendinblue in accordance with Art. 28 GDPR. Sendinblue is a certified German provider that was selected in accordance with the requirements of the General Data Protection Regulation and the German Federal Data Protection Act. For more information, please visit https://de.sendinblue.com/datenschutz-uebersicht/

You can revoke your consent to the storage of your data and email address, as well as their use for sending the newsletter, at any time, for example via the “unsubscribe” link in the newsletter.
As data protection measures are always subject to technical updates, we kindly ask you to review our data protection measures at regular intervals by consulting our Privacy Policy.

Contact forms / Contact Form 7 / Flamingo plugin

Our website contains various subject-specific forms: for contacting us, submitting applications, registering for events or webinars, and booking training courses, among others. Certain content such as flyers, white papers, etc. is also only made available for download after registration.

Registration on our website is a prerequisite for participating in our events and processing your requests. We collect personal and business-related data via an input mask. The questions and the scope of the data fields in the contact forms will differ in line with the purpose.

The contact forms on this website use the WordPress plugins Contact Form 7 and Flamingo (open source software for WordPress). Flamingo stores the form entries (with the exception of attached files) on the website server. The Flamingo plugin stores data requested and transmitted via forms in the database on the web server. Contact Form 7 does not store any data, but transmits the completed contact form fields to us by email. If you send us enquiries via the contact form, the information you provided in the enquiry form, including the contact details you have provided there, will be stored by us for the purpose of processing the enquiry, as well as in the event of any follow-up enquiries. These data are processed in accordance with Art. 6(1)(b) GDPR, provided that your enquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR).

We exclusively require these data in order to be able to contact you and to provide you with the requested information. Subsequently, your data will not be processed further, unless you have agreed to receive additional information, primarily via email, when registering. The corresponding contact forms contain a separate note on data protection for this purpose. You may request the deletion of your data or the erasure of information at any time.

We process the data you have submitted to us in connection with your application in order to assess your suitability for the position (or other open positions in our companies, if applicable) and to carry out the application procedure (Section 26 of the German Federal Data Protection Act (BDSG)). Within our company, your personal data will only be disclosed to those employees who are involved in the application process. In the event of a rejection, your data will be deleted after no more than 6 months. If the application is successful, we will store the data in your HR file. You have the right to obtain information about any of your personal data processed by us at any time. Furthermore, you have a right to the correction or deletion of your data or to the restriction of processing (Sections 15, 16, 17, 18 BDSG). You may object to the processing of these data at any time in writing (including via email) (Section 21 BDSG). However, please note that in the event of such an objection, we will no longer be able to process your application.

Encryption of emails sent with our forms: Transport Layer Security (TLS) is a cryptographic protocol designed to provide communications security over a computer network by preventing the interception, manipulation and falsification of messages. TLS uses a symmetric encryption method to encrypt all data traffic between the sender and receiver.

Links to external websites / integration of plugins

We maintain an online presence on social networking sites and platforms in order to communicate with the customers, interested parties and users who are active on these sites and platforms and to inform them about our services. Our website contains external links to these networks and platforms in the form of links/buttons.
If you click on these external links and thereby access these social networking sites, personal data may be transmitted to the provider of the respective social networking site. In this case, user data may also be transmitted to a server in a third country. If you are logged in to the respective network with your personal user account while visiting such a website, the network will be able to assign your visit to this account. For more information on data processing and your rights in this regard, please refer to the terms and conditions of the respective network operator:

Unless otherwise stated in our Privacy Policy, we only process the data of users who communicate with us within the social networking sites and platforms, e.g., who write posts on our pages or send us messages.

YouTube

Our website uses plugins from YouTube (YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA) to integrate and display video content. If you have consented to the use of YouTube in the cookie notice, a connection to the YouTube servers will be established when you call up a page with an integrated YouTube plugin. In this case, user data may also be transmitted to a server in a third country. YouTube will then be notified which of our pages you have visited. If you are logged into your YouTube account, YouTube can assign your surfing behaviour directly to your personal profile. You can prevent this by logging out beforehand.

Videos are embedded on our website using the extended data protection mode. As a result, videos are not accessed via youtube.com, but via youtube-nocookie.com, which significantly reduces the amount of data processed. According to YouTube, the extended data protection mode prevents, among other things, playback of the video from being used to personalise your user experience on YouTube or for personalised advertisements.

For details on the handling of user data, please refer to YouTube’s privacy policy at https://www.google.de/intl/de/policies/privacy.

YouTube will only process your data if you have given your consent in accordance with Art. 6(1)(a) GDPR. Otherwise, the embedded YouTube videos will be blocked by default. You can give your consent at any time by using the cookie box that appears when you first visit the website, by giving your consent when viewing the blocked video, or in the Privacy Policy itself. To withdraw your consent, you can either adjust the cookie settings in this Privacy Policy or deactivate the button in this section below.

Rights of data subjects

According to the GDPR, you have the following rights as a data subject:

  • Right of access (Art. 15 GDPR): you have the right to obtain information about any personal data stored about you, their source, the purposes for which they are processed, their recipients, and the duration for which they are stored.
  • Right to rectification (Art. 16 GDPR): if we have recorded any personal data relating to you incorrectly, you have the right to request that they be rectified.
  • Right to erasure (Art. 17 GDPR): you have the right to request the deletion of your data, provided that this does not conflict with any statutory retention periods or other legal obligations on our part. We will delete data stored by us or block them from being processed if they are no longer required for their intended purpose, and they are not subject to any statutory retention periods or other legal obligations on our part.
  • Right to restriction of processing (Art. 18 f. GDPR): you have the right to request a restriction of the processing of your data under the conditions specified in Art. 18 GDPR.
  • Right to data portability (Art. 20 GDPR): you have the right to request that your data collected by us be made available to another data controller, provided that this is technically feasible.
  • Right to object (Art. 21 GDPR): in the case of data processing based on the legal basis of legitimate interest (Art. 6(1)(f) GDPR), you have the right to object to the processing at any time.

Please send any such requests by email to datenschutz@evaco.de. Please note that in the case of such requests, we may need to be able to verify that you are indeed the relevant data subject. If we are processing your data on the basis of your consent, you may revoke this consent at any time in accordance with Art. 7(3) GDPR. For more information on exercising your right to withdraw your consent, please refer to the relevant sections of this Privacy Policy.

You also have the right to complain to a data protection supervisory authority in the event that we have failed to comply with the provisions of data protection law.

We value your trust above all else, which is why we are always available to answer any questions you may have regarding the current processing of your personal data. Please contact us should you have any questions that are not answered by this Privacy Policy, or if you would like to receive more detailed information regarding a particular point.
